Key Findings Summary

  • CRITICAL: $308,800 deposited and $310,010 withdrawn on same day from a brand-new ANZ account (3 Sep 2021) via a branch "card entry" β€” highly irregular.
  • CRITICAL: $314,000 from the sale of 1 Shelley Avenue diverted to a corporate loan (Morelli Bros Pty Ltd) β€” valued at NIL by Respondent in court proceedings.
  • CRITICAL: 131 May Terrace, Ottoway (valued $415,000) transferred to Anthony Sabato with no consideration visible in bank records.
  • CRITICAL: Sandy Creek property ($600,000) mortgaged to Lampard family (Victoria) β€” private individuals who registered ABNs weeks before the transaction.
  • HIGH: ATM structuring β€” 7 separate cash deposits at same machine on same day (30 Sep 2021) totalling $4,940 β€” AML red flag.
  • HIGH: Anthony Sabato paid ~$133,000+ in "dividends" from ANZ 7663 across 2022–2025. Also co-owned two properties with Respondent. Listed as a $70,000 creditor.
  • HIGH: Morelli Prospect PG Trust trustees' resolution for FY2023 income signed 12 months late β€” creating tax/legal risk and suggesting retroactive structuring.
  • HIGH: Multiple trusts and companies (7+ entities) structure assets in ways that obscure the Respondent's true beneficial ownership.
  • MEDIUM: $900,000 private loan from "CFA Finance" β€” no documentation, no security details disclosed.
  • MEDIUM: ATO debt of ~$190,000 β€” described as "paid through private lender" with no supporting evidence.
  • MEDIUM: Superannuation of only $27,118 declared despite significant business income β€” appears undervalued.
  • MEDIUM: Three "Details Advised Separately" payments totalling $17,719 β€” no payee identified.
  • MEDIUM: Morelli Bros Investment Trust financial reports disclosed only to FY2022, despite the trust having $526,000 ANZ debt as at Dec 2025.
  • MEDIUM: Water rates at Prospect Road trust property increased 220% in one year ($1,900 β†’ $6,080) with no explanation.
  • Home contents and tools of trade valued NIL by Respondent vs $150,000 by Applicant β€” implausible given scale of property portfolio.

New Critical Findings (from expanded document review)

  • CRITICAL: 19 Penley Ave, Wingfield purchased for ~$212,500 but declared at $800,000–$900,000 β€” a $687,500 valuation discrepancy requiring immediate investigation.

  • CRITICAL: Undisclosed criminal charges on Feb 2025 ANZ loan application ($1.34M facilities) β€” potential loan application fraud.
  • CRITICAL: Darwin cash deposits in CBA 5063 β€” interstate AML indicator for SA-based business.
  • HIGH: Active A/C business income (CBA 5063, Dec 2025 photos) while claiming inability to work/afford valuations.
  • HIGH: $900K CFA Finance loan routed through solicitor trust account β€” no independent documentation.

  • HIGH: Medical records breach β€” Gianna's records obtained without authorisation and weaponised in proceedings.
  • HIGH: Child suicidal ideation documented Nov 2021 (age 7) and May 2025 (age 11). Child Impact Report recommends psychiatric assessment for father β€” not completed 8 months later.
  • HIGH: Third-party surveillance of child at soccer club (Paul Berlingeri, Feb–Mar 2026). 50m exclusion order granted Mar 2026.
  • MEDIUM: 18 Arthur St, Pennington ($550K) β€” additional property acquisition during proceedings, linked to Sandy Creek deal.

Methodology & Assumptions

Methodology

  • Transaction tracing: Every transaction across all available bank statements was extracted, categorised and cross-referenced against other accounts and documents.
  • Entity mapping: All companies, trusts and business names associated with the Respondent were identified via ASIC, ABN Lookup and court documents.
  • Recurring party analysis: All payees and payers were identified and their total flows quantified across the period.
  • Red flag analysis: Transactions were assessed against standard AML/forensic accounting indicators including structuring, round-number transfers, same-day cycling, and opaque descriptions.
  • Cross-document reconciliation: Rental income from trust financial reports was reconciled against bank statement inflows from CS Real Estate / Remitter deposits.
  • OSINT: Public records searches via ASIC, ABN Lookup, and Land Services SA were conducted to verify entity registrations and property title information.
  • Balance sheet analysis: The sealed court balance sheet was analysed for internal inconsistencies, disputed values and missing items.

Assumptions & Gaps

  • Where bank statements were not available for certain periods (particularly ANZ 7663 Statements 2–16), transactions for those periods could not be reviewed.
  • Property values have been taken from court-submitted valuations. No independent valuation has been obtained for this report.
  • The Morelli Bros Investment Trust financial reports for FY2023 and FY2024 were not available β€” estimated figures used where needed.
  • The identity and terms of the CFA Finance private loan ($900,000) are unknown β€” no loan documents were provided.
  • The Lampard family mortgage on Sandy Creek has unknown interest rate and repayment terms.
  • Account 015214153957663 (recipient of large transfers from ANZ 8937) has not been identified β€” assumed to be another account in Respondent's name based on BSB.
  • Superannuation balance of $27,118 is taken from a screenshot dated Sep 2025 β€” no certified statement provided.
  • All figures are in Australian Dollars (AUD).

Background β€” Financial Structure & Timeline

The Respondent's Financial Structure

The Respondent, Adam Isacc Morelli (DOB 27/11/1984), operates a complex network of investment properties, trusts and companies. The structure is designed such that beneficial ownership is held through discretionary trusts and corporate trustees, significantly obscuring the Respondent's direct net worth.

At its core, the structure comprises:

  • Personal account (ANZ 7663) β€” the primary operating account receiving rental income, making mortgage payments, and transferring to related entities.
  • Morelli Prospect PG Trust β€” holds 140–140A Prospect Road ($2.1M), financed by a $793,334 ANZ commercial bill facility. Sole beneficiary: Adam Morelli.
  • Morelli Bros Investment Trust β€” holds commercial/industrial properties ($526,000 ANZ debt). Financial reports only disclosed to FY2022.
  • Torrensville PG Trust β€” holds 50% of 81 Hayward Ave, Torrensville ($550,000).
  • Sandy Morelli PG Pty Ltd β€” acquired 728 Barossa Valley Hwy, Sandy Creek ($600,000) September 2025.
  • Morelli 412 Cavan PG Pty Ltd β€” holds 4/12 William Street, Cavan ($575,000).
  • Anthony Sabato β€” a connected business associate who co-owned properties, receives regular "dividend" payments, and is listed as a creditor for $70,000.

Key Financial Timeline

  • Pre-2021: Respondent holds multiple investment properties, operates business through CBA accounts 5063 and 9381.
  • Apr 2021: 27 River Drive, Paisley sold for $220,000 (net $218,443 to vendor).
  • Aug 2021: Morelli Prospect PG Trust purchases 140–140A Prospect Rd for $1,850,000. ANZ 7663 account opened (Statement 1, $0 balance).
  • 3 Sep 2021: $308,800 deposited into new ANZ 7663 account from another account, then $310,010 withdrawn same day via branch card entry β€” likely property settlement funds.
  • Oct 2021: 1 Shelley Ave, Fulham Gardens sold for $892,000. $314,000 diverted to corporate loan. $261,885 repays mortgage.
  • Apr 2022: ANZ 8937 account active with multiple tenants (Emir Bitic - Wingfield, C. Lubcke, Haider Ali - Torrensville).
  • Sep 2022: ANZ 8937 drained β€” $23,139 transferred internally, $8,020 to Sabato in one day.
  • 2024–2025: Two Athena mortgages active (~$9,000/month combined). CS Real Estate manages multiple properties generating ~$90,000+/year rental income. Commercial bill facility rolls over monthly.
  • Sep 2025: Sandy Creek property acquired ($600,000) via Sandy Morelli PG Pty Ltd, mortgaged to Lampard family.
  • Dec 2025: Court sealed balance sheet filed β€” total assets $8.19M, liabilities $4.52M.

Analysis & Findings β€” Red Flags

28 suspicious items identified across all documents reviewed, ranked by severity.

🚨 CRITICAL 1 Same-Day $308,800 In / $310,010 Out β€” Brand New Account
On 3 September 2021, just weeks after ANZ 7663 was opened (with $0 balance), $308,800 was transferred in from account 324446586. On the SAME DAY, $310,010.00 was withdrawn via a "Card Entry at West Lakes Branch." This is not a normal retail transaction β€” branch card entries of this scale represent counter withdrawals, bank cheques or structured cash transactions. The account was brand new and had no prior history. The withdrawal exceeded the deposit by $1,210 (the account's existing small balance). This event represents 91% of all deposits in the account's first statement period and warrants immediate investigation as to where the $310,010 went.
$310,010.00 β€” untraced withdrawal
🚨 CRITICAL 2 $314,000 from Shelley Ave Sale Diverted to Corporate Loan β€” Valued NIL
The 2021 sale of 1 Shelley Avenue, Fulham Gardens ($892,000) resulted in $314,000 being paid directly at settlement to reduce "Morelli Bros Pty Ltd Loan No. ...5237" β€” a company loan, not a personal one. This effectively removed $314,000 from what could otherwise be a joint matrimonial asset into a corporate structure. The Respondent has valued this item at NIL in court proceedings while the Applicant values it at $314,000. This discrepancy is unresolved and represents a direct conflict on a material asset.
$314,000 β€” disputed & potentially non-disclosed
🚨 CRITICAL 3 131 May Terrace, Ottoway β€” Transferred to Anthony Sabato
This property was co-owned 50/50 between the Respondent and Anthony Sabato. It has been transferred and the Respondent now values his share at NIL. A valuation of $415,000 (full property) was obtained August 2024, implying the Respondent's 50% share was worth approximately $207,500. No transfer consideration appears in the bank statements reviewed. The transfer of a $207,500 asset to a connected party (who also receives regular dividend payments and is listed as a creditor) without visible consideration is a significant concern.
~$207,500 β€” Respondent's 50% share, valued NIL
🚨 CRITICAL 4 Sandy Creek Mortgaged to Lampard Family β€” ABNs Registered Weeks Before Deal
728 Barossa Valley Hwy, Sandy Creek ($600,000) was purchased September 2025 through Sandy Morelli PG Pty Ltd and immediately mortgaged to three individuals: Cyril Thomas Lampard, Paul Andrew Lampard, and Sandra Marie Lampard β€” all based in Victoria. ABN Lookup confirms Cyril Lampard's ABN was activated 23 June 2025 (business: "Caravan Building") and Paul Lampard's ABN was activated 16 May 2025 β€” both just weeks before the September 2025 transaction. Private mortgages to individuals with no lending business history whose ABNs were registered immediately before the transaction is a strong indicator of a related-party or sham lending arrangement. This could be used to inflate liabilities and reduce the apparent net value of the property pool.
$600,000 property β€” mortgage amount unknown
⚠ HIGH 5 ATM Structuring β€” 7 Cash Deposits, Same Machine, Same Day
On 30 September 2021, seven separate ATM deposit transactions were made at Woodville North Branch #1 ANZ ATM, all on the same day: $20, $20, $630, $860, $960, $970, $1,480. Total: $4,940. Making multiple separate cash deposits at the same machine on the same day, in amounts below common reporting thresholds, is a classic anti-money laundering (AML) structuring pattern (also known as "smurfing"). This is a reportable indicator under the Anti-Money Laundering and Counter-Terrorism Financing Act 2006.
$4,940 β€” structured across 7 deposits
⚠ HIGH 6 Anthony Sabato β€” ~$133,000 in Payments, Co-Owner, Creditor
Anthony Sabato appears in multiple roles: (a) co-owner of 131 May Terrace, Ottoway (transferred away); (b) co-owner of 19 Penley Ave, Wingfield (transferred into trust); (c) regular recipient of "dividend" payments from ANZ 7663 and ANZ 8937 totalling ~$133,000 across 2022–2025; (d) listed as a $70,000 creditor on the court balance sheet. The combination of asset transfers to/with Sabato, regular large cash flows, and a claimed debt obligation suggests this relationship requires thorough investigation to determine whether it is genuine and arm's length.
~$133,000 + $70,000 creditor + 2 property transfers
⚠ HIGH 7 Trust Trustees' Resolution Signed 12 Months Late
The Morelli Prospect PG Trust trustees' resolution distributing FY2023 income ($34,412 to Adam Morelli) was dated and signed on 3 July 2024 β€” over 12 months after the 30 June 2023 year end. Under ATO requirements, resolutions must be made by 30 June of the relevant year. A late resolution may mean the distribution is technically invalid for FY2023 tax purposes and could represent retroactive structuring of the trust's income. The FY2024 resolution was also signed in January 2025, approximately 7 months after year end β€” again late.
$34,412 distribution β€” legally questionable timing
⚠ HIGH 8 $900,000 Private Loan (CFA Finance) β€” No Documentation
The court balance sheet lists a $900,000 liability to "CFA Finance" β€” a private lender. No loan documents, security details, interest rate, repayment terms or lender identity have been provided. The ATO debt of ~$190,000 is stated to have been paid through this private loan. The existence of a $900,000 undocumented private lending arrangement inflates the Respondent's total liabilities and reduces the apparent net asset pool by a significant amount. Without documentation, this liability cannot be verified.
$900,000 β€” unverified private liability
⚠ HIGH 9 "Details Advised Separately" β€” $17,719 with No Payee
Three withdrawals from ANZ 7663 use the opaque description "Details Advised Separately" with no payee identified: 24 March 2025 ($1,241.00), 28 March 2025 ($7,179.39), and 19 May 2025 ($9,298.89). This ANZ notation means the payee details were not captured electronically at the time. The total of $17,719.28 represents untraceable outflows. These should be investigated with ANZ to identify the recipients.
$17,719.28 β€” no payee identified
⚠ HIGH 10 Morelli Bros Investment Trust β€” No FY2023/2024 Financial Reports
The Financial Index discloses Morelli Bros Investment Trust financial reports only to FY2022. However, the court balance sheet (December 2025) shows an active ANZ commercial bill debt of $526,000 for Morelli Bros Pty Ltd. Three years of trust financial reports are missing from discovery despite the trust remaining financially active with significant debt.
$526,000 active debt β€” no recent trust accounts
⚠ MEDIUM 11 Large One-Off Payments to Unknown Individuals
Multiple large one-off payments were made to individuals with no business description or surname: Fabio Perrone $12,500 (June 2025), Josef $6,000 (July 2025), John $2,200 (Nov 2024), Kosta $2,587 (Nov–Dec 2024), Robin Turner & Associates $5,000 (May 2025), Micah $3,400 (Mar–Apr 2025). These cannot be verified without further investigation.
$31,687 β€” unverified individual payments
⚠ MEDIUM 12 Superannuation Significantly Undervalued
The Respondent declares superannuation of only $27,118 (Colonial First State, screenshot Sep 2025). Given the Respondent's apparent business income, property portfolio (acquired since at least 2017), and age (born 1984, now ~40), a superannuation balance of $27,118 is extremely low. The national average superannuation balance for males aged 40–44 is approximately $130,000–$150,000. Only one super fund (Colonial First State) has been disclosed; it is possible other super interests exist.
$27,118 declared β€” possibly materially understated
⚠ MEDIUM 13 Water Rates β€” 220% Increase at Prospect Road Trust
Water charges for 140–140A Prospect Road (Morelli Prospect PG Trust) increased from $1,900 (FY2023) to $6,080 (FY2024) β€” an increase of 220%. This is unexplained. For a property of this nature, such an increase could indicate a major leak, incorrect allocation of another property's water bills to this trust, or a deliberate inflation of deductible expenses to reduce taxable income.
$6,080 β€” 220% year-on-year increase unexplained
⚠ MEDIUM 14 ANZ 8937 β€” Large Same-Day Drain to Sabato & Unknown Account
On 6 September 2022, ANZ account 8937 (which had accumulated $35,660 in rental income) was drained of over $31,000 in a single day: $8,019.70 paid to Anthony Sabato and $23,139.63 transferred to unidentified account 015214153957663 (BSB 015-214). The same account number received further transfers on 15 Dec 2022 ($3,721.63 and $7,067.55). Account 015214153957663 has not been identified in any disclosed document and may represent an undisclosed ANZ account held by the Respondent.
$33,928 transferred to unidentified parties in one day
⚠ MEDIUM 15 Home Contents & Tools of Trade β€” Valued NIL
The Respondent values home contents, furniture and tools of trade at NIL. The Applicant estimates $150,000. Given the Respondent owns a $1.9M property at West Lakes, operates multiple businesses, and owns a Ferrari and classic vehicles, a NIL valuation of home contents is not credible. Tools of trade for a property developer/investor would typically include significant equipment, vehicles (not separately listed) and professional assets.
$150,000 β€” Applicant estimate vs NIL declared by Respondent
🚨 CRITICAL 16 Wingfield Property β€” $687,500 Valuation Discrepancy
19 Penley Ave, Wingfield was purchased for approximately $212,500 (referenced in Sandy Creek contract of sale). It is now declared in court proceedings at $800,000–$900,000. If the original purchase price is correct, the property has been overvalued by up to $687,500 in the asset pool, or alternatively represents a massive undisclosed capital gain that was never reported. Either scenario requires immediate investigation β€” the gap between $212,500 and $900,000 is extraordinary.
$687,500 β€” valuation gap unexplained
🚨 CRITICAL 17 Undisclosed Criminal Charges on ANZ Loan Application
In February 2025, ANZ approved $1.34M in new lending facilities (Morelli Bros $526K + Morelli Prospect PG $815,834). At the time of application, Adam was facing major indictable criminal charges (firearms, drugs, electricity diversion) filed February 2024. Standard loan applications require disclosure of pending criminal charges. Failure to disclose constitutes potential loan application fraud β€” a separate criminal offence under the Criminal Law Consolidation Act 1935 (SA).
$1.34M β€” facilities obtained with undisclosed criminal charges
🚨 CRITICAL 18 Darwin Cash Deposits β€” Interstate AML Indicator
CBA 5063 bank statements show multiple cash and cheque deposits made in Darwin, Northern Territory. Adam's business (Airconditioning Adelaide) is purportedly SA-based. Interstate cash deposits into a business account, particularly in a remote jurisdiction, are a significant AML red flag. This pattern suggests either undisclosed interstate business activity or structured deposits designed to avoid detection by splitting across jurisdictions.
Multiple Darwin deposits β€” interstate structuring indicator
🚨 CRITICAL 19 10 Distinct Criminal Case Numbers
Criminal court records reveal at least 10 distinct case numbers for Adam Morelli: DCCRM-25-012088 (firearms β€” committed to District Court), MCCRM-24-005134 (drugs/electricity), MCCRM-23-025294 (DV assault β€” withdrawn), MCCRM-23-025205 (intervention order), MCPAD-21-2285 (electricity meter β€” fined $600), plus additional matters. The escalating pattern from utility theft (2021) to DV (2023) to firearms and drug cultivation (2024) is directly relevant to child safety and parenting capacity assessments.
10+ criminal cases β€” escalating severity pattern
⚠ HIGH 20 Business Income While Claiming Inability to Work
CBA 5063 statements from Jul 2024–Jul 2025 show ongoing business activity for Airconditioning Adelaide / Air Diffusion, including customer payments, supplier invoices, and trade supplies. Simultaneously, Adam's solicitors claimed he was unable to afford valuations and struggled with legal costs. Photographic evidence from December 2025 shows Adam actively working on air conditioning installations. This contradicts representations made to the Court about his financial capacity.
Active business income vs inability-to-work claims
⚠ HIGH 21 $900K Private Loan Routed Through Solicitor Trust
The $900,000 CFA Finance loan appears to have been routed through a solicitor's trust account (Lampard-connected). Using a solicitor trust account as a conduit for private lending obscures the true source of funds and creates an additional layer of opacity. No independent loan documentation, security registration, or evidence of arm's length terms has been provided for this liability which reduces the net asset pool by $900,000.
$900,000 β€” routed through solicitor trust
⚠ HIGH 22 CBA Total Lending Facilities β€” $2,891,000
BFD (Broker Financial Documents) reveal the full extent of CBA lending: Athena refinance $2,391,000 (covering West Lakes, Hayward Ave, multiple Cavan units) plus a new $500,000 facility = $2,891,000 total CBA debt. This level of institutional lending, combined with the ANZ facilities ($526K + $815K) and the $900K private loan, means total declared liabilities significantly exceed what was initially disclosed.
$2,891,000 β€” total CBA facilities revealed
⚠ HIGH 23 Medical Records Breach
Evidence indicates Adam or persons acting on his behalf obtained Gianna's medical records without authorisation. This constitutes a breach of the Health Records and Information Privacy Act and was used to make allegations about Gianna's mental health and substance use in court proceedings. The weaponisation of improperly obtained medical records is a serious matter.
Unauthorised access to medical records
⚠ HIGH 24 Third-Party Surveillance of Child
Paul Berlingeri made inquiries at Alessandro's soccer club on Adam's behalf (Feb–Mar 2026), and Adam attended school events (Dec 2025) despite the spirit of court orders. Sending third parties to monitor a child's extracurricular activities demonstrates a pattern of surveillance and control that was specifically addressed by Justice Parker's 50-metre exclusion order in March 2026.
Surveillance via third parties at child's activities
⚠ MEDIUM 25 Child Suicidal Ideation β€” Nov 2021 and May 2025
Alessandro (born Apr 2014) expressed suicidal ideation on at least two occasions: November 2021 (age 7, around separation) and May 2025 (age 11, during proceedings). The Child Impact Report (Jul 2025) documented significant anxiety, distress, and refusal to see his father. School reports note emotional difficulties. These are directly relevant to the Court's parenting assessment and the ICL's recommendations.
Child welfare β€” 2 documented suicidal ideation episodes
⚠ MEDIUM 26 Sandy Creek Contract β€” Pennington Purchase Linked
The Sandy Creek contract of sale (728 Barossa Valley Hwy, $595,000) references a linked transaction for 18 Arthur St, Pennington ($550,000). The Pennington purchase appears to be funded through the same network of private lending and corporate structures. Both transactions occurred during active court proceedings, increasing the property portfolio from 9 to potentially 13 active properties.
$550,000 β€” additional property during proceedings
⚠ MEDIUM 27 Superannuation Updated β€” Still Minimal
Updated superannuation screenshot (Sep 2025) shows $153,604 (Respondent) β€” increased from $27,118 initially declared. Applicant's super is $111,175 (Aware Super). While the updated figure is more realistic, it remains low for a 40-year-old with a $8M+ property portfolio and significant business income. Total super pool: $264,779.
$153,604 β€” updated but still potentially understated
⚠ MEDIUM 28 Drug Cultivation at Properties Where Child Visited
Criminal charges (Jan 2024) include drug cultivation and prescribed equipment at West Lakes (primary residence) and Cavan (investment property). Alessandro had lived at and visited both properties. The ICL's outline notes this as a significant child safety concern. The combination of firearms, drugs, and a child's presence at these locations is directly relevant to the Court's assessment of risk.
Drug cultivation at child's known locations

CONCERN Medical Records Breach
Evidence indicates Adam or persons acting on his behalf obtained Gianna's medical records without authorisation. These records were then used by ALS to make allegations about Gianna's mental health and substance use. ALS threatened to subpoena Gianna's treating practitioners (23 April 2025) β€” characterised by Gianna's solicitors as weaponising mental health as a litigation tactic. This is a potential breach of the Health Records and Information Privacy Act.

Drug Test Orders β€” Context

Gianna's February 2026 affidavit addressed her drug history directly: acknowledged opioid dependence and recent Panadeine Forte use. The hair follicle test (ordered 13 Mar 2026) covers opioids, benzodiazepines, and illicit substances over a 6-month window. This is at Gianna's expense. Adam has not been ordered to undergo drug testing despite criminal charges including drug cultivation and prescribed equipment.

CRITICAL Why These Gaps Matter

The missing statement periods coincide with the most financially significant events in this matter:

  • CBA 5063 gap (Oct 2019 – Jul 2024): Covers the ENTIRE period of property acquisitions, trust formations, and business transactions. This is the confirmed Airconditioning Adelaide business account β€” 4+ years of business income and expenditure are invisible.
  • CBA 9381 gap (Oct 2020 – Sep 2023): This account was NEVER DISCLOSED in Adam's Financial Statement. Three years of transactions in a hidden account during the separation period.
  • ANZ 7663 gap (Oct 2021 – Apr 2024): Covers the entire post-separation period including when Shelley Ave sale proceeds would have been managed, Anthony Sabato payments began, and trust structures were being set up.
  • Combined effect: Over the critical 2020-2024 period, Adam's three main operating accounts have a combined ~10 years of missing statements. This makes it impossible to trace the flow of funds from property sales, verify the legitimacy of liabilities, or identify further undisclosed transactions.

Priority Documents to Obtain

  • URGENT: CBA 5063 Statements 8-26 (Oct 2019 – Jul 2024) β€” 4 years 9 months of business account activity
  • URGENT: CBA 9381 Statements 65-70 (Oct 2020 – Sep 2023) β€” 3 years of undisclosed account activity
  • HIGH: ANZ 7663 Statements 2-16 (Oct 2021 – Apr 2024) β€” 2.5 years of primary account
  • MEDIUM: ANZ 8937 Statements 1-6 (account opening to Apr 2022) β€” pre-disclosure period
  • MEDIUM: Athena 7645 & 7652 Offset statements (Jan 2025 onward)
  • RECOMMENDED: Subpoena ANZ for identification of unknown account 015214153957663

Conclusions & Expert Opinions

Opinion 1 β€” Non-Disclosure of Material Assets

Based on the documents reviewed, it is my opinion that the Respondent has not made full and frank financial disclosure in these proceedings. Specifically:

  • The $314,000 diversion from the Shelley Avenue sale to a corporate loan, now valued at NIL, represents a material non-disclosure or misrepresentation.
  • The transfer of 131 May Terrace, Ottoway to Anthony Sabato (value ~$207,500) with no visible consideration is unexplained and potentially a disposition of assets to defeat a claim.
  • The Morelli Bros Investment Trust has no financial reports for FY2023 or FY2024 despite having $526,000 in active ANZ debt.
  • The identity and terms of the $900,000 CFA Finance private loan are undisclosed.

Opinion 2 β€” Asset Structuring to Obscure Beneficial Ownership

The Respondent has structured assets across at least 7 trusts and companies, all of which appear to be ultimately controlled by and beneficially owned by Adam Morelli. This structure makes it difficult to assess the true net worth of the Respondent without access to all entity financial records. The consistent use of "PG" in entity names (Morelli Prospect PG Trust, Sandy Morelli PG Pty Ltd, Morelli 412 Cavan PG Pty Ltd) suggests a deliberate and coordinated naming convention, possibly designed by a legal or accounting adviser.

Opinion 3 β€” Sandy Creek Mortgage is Suspicious

The mortgage over 728 Barossa Valley Hwy, Sandy Creek to the Lampard family (Victoria) is highly suspicious. The mortgagees are private individuals with no disclosed lending business. Their ABNs were registered in May–June 2025, weeks before the September 2025 transaction. This pattern is consistent with a related-party mortgage arranged to create an artificial liability against the property, thereby reducing its apparent equity value in these proceedings.

Opinion 4 β€” Anthony Sabato is a Connected Party Requiring Investigation

Anthony Sabato's role as co-owner, "dividend" recipient (~$133,000), creditor ($70,000), and recipient of transferred property (131 May Terrace) places him as a central connected party. His relationship with the Respondent warrants full investigation, including production of any partnership, trust or shareholder agreements, and confirmation of whether the property transfer and cash payments are genuine arm's length transactions.

Opinion 5 β€” Commercial Bill Facility Inflates Statement Totals

The headline figures of $1.2M–$1.5M flowing through ANZ 7663 in 6-month periods are substantially attributable to commercial bill rollovers ($526,000 and $815,834) that are same-day in/out and net to zero. The real operational cash flow is approximately $185,000–$190,000 per 6-month period β€” a materially different figure relevant to assessing the Respondent's income and lifestyle.

Opinion 6 β€” Wingfield Valuation Discrepancy Requires Urgent Investigation

The Sandy Creek contract of sale references 19 Penley Ave, Wingfield as having been purchased for approximately $212,500. This property is declared in court proceedings at $800,000–$900,000. If the original purchase price is accurate, the property has either been dramatically overvalued to inflate the gross asset pool (while liabilities absorb the difference), or represents a massive undisclosed capital gain. Either scenario is material and requires independent title search verification, original contract production, and explanation from the Respondent.

Opinion 7 β€” Criminal Charges Undermine Credibility and Loan Applications

The Respondent faces at least 10 distinct criminal case numbers including major indictable firearms offences committed to the District Court. These charges were not disclosed on the February 2025 ANZ loan application for $1.34M in new facilities β€” a potential offence under the Criminal Law Consolidation Act 1935 (SA). The escalating pattern from utility theft (2021) to domestic violence (2023) to firearms and drug cultivation (2024) at properties where the child resided is directly relevant to both the financial and parenting proceedings.

Opinion 8 β€” Active Business Income Contradicts Inability Claims

CBA 5063 bank statements (Jul 2024–Jul 2025) show ongoing Airconditioning Adelaide business activity including customer receipts, supplier payments, and trade supplies. Photographic evidence from December 2025 shows Adam actively working on air conditioning installations. These facts directly contradict representations made to the Court and to Gianna's solicitors that Adam was unable to afford valuations or struggling with legal costs. The business has been operating throughout the proceedings while being valued at NIL in the court balance sheet.

Opinion 9 β€” Property Acquisitions During Proceedings Demonstrate Financial Capacity

The acquisition of Sandy Creek ($595,000) in September 2025 and the proposed purchase of Pennington ($550,000) β€” both during active family law proceedings β€” demonstrates significant financial capacity and access to credit. Combined with the $1.34M ANZ facility extension (February 2025), the Respondent has committed to approximately $2.5M in new property and lending while simultaneously claiming inability to meet disclosure obligations and afford court-ordered valuations.

Opinion 10 β€” Child Safety Concerns Are Substantiated

The combination of (a) drug cultivation and firearms offences at properties where the child resided, (b) two documented episodes of child suicidal ideation, (c) the Child Impact Report recommending psychiatric assessment, (d) third-party surveillance at the child's activities, and (e) 8 months of non-compliance with the CIR's psychiatric assessment recommendation, collectively substantiate the child safety concerns raised by the Applicant and the ICL. The Court's March 2026 restraining order (50m exclusion from school/activities) reflects the seriousness of these concerns.

vs CHILD SUPPORT
17–35Γ— understatement to Services Australia
Child Support assessment (17 Oct 2025): Adam's estimated income $28,404/yr; minimum-rate child support payable $534/yr.
ANZ-declared monthly income $40,701 = $488,412/yr. SOFP rental income alone = $350,120/yr gross.
Ratio: ANZ disclosure is 17Γ— the CS figure; combined rent + interest income approx 35Γ—.

Vehicles declared on the Pennington application

  • 2021 Toyota Hilux SR5 β€” $15,000
  • 1991 Ferrari 348tb β€” $200,000 (note: SOFP April 2025 valued same vehicle at $200,000; Sealed Financial Statement March 2024 valued at $119,500; Balance Sheet July 2023 marked TBV)
  • 1975 Ford Falcon GT XB β€” $100,000

Other declarations referenced

  • Property security: 18 Aythrie St Pennington (purchase target)
  • Loan term, rate and conditions: standard ANZ home-loan offer (terms in source PDF, 33 pages)
  • Co-applicant / guarantor declarations: signed
  • Adam's address listed: TBC against bail-required address (1/81 Hayward Ave Torrensville)

Forensic significance

Banks rely on the truth of an applicant's signed declarations under the National Consumer Credit Protection Act and bank-specific responsible-lending obligations. Demonstrably false declarations (whether to the bank or to the Court / Services Australia) carry both criminal and civil consequences. The two figures cannot both be true.

Implication for property settlement: Adam's true asset position is materially higher than what has been disclosed in family-law proceedings. The pool of net assets available for division should be re-baselined.

πŸ” CBA Refinance β€” $2,365,000 Across 3 Trusts

Three back-to-back CBA "BetterBusiness Loan" Letters of Offer signed by Adam on 23 March 2026, refinancing existing ANZ debt across the Morelli trust group. All three are cross-collateralised; broker is Australian Finance Group.

CROSS-COLLATERAL
All trusts in the same security web
Morelli Bros Pty Ltd (Investment Trust) provides unlimited guarantees and a 1st mortgage over 35 York St Wingfield; the same entity also gives a 1st mortgage over 19 Penley Ave Wingfield supporting the Sandy Creek facility. A default on any one facility could cascade across the entire trust portfolio. Combined with Adam's personal guarantee (limited to each loan amount), this exposes ~$5M+ of property + Adam's personal estate.

πŸ’Έ Family-Network Payments & Cash Flows

Recurring transfers between Adam and his immediate family / business network β€” many unexplained, several aligned in time with criminal-law events affecting cousins.

$470,028
Transfer to Laurence Perone β€” 14 February 2024
Single payment of $470,028.00 on 14 Feb 2024 labelled "Perone Fee". Adam refused to clarify when asked. Laurence Perone is the only one of the four Perrone cousins NOT arrested in the 2023 group-shooting murder investigation. Cousin Fabio Perrone was granted $950,000 bail in approximately Sep 2026 β€” Gianna believes Adam funded that bail using proceeds from the Sandy Creek property purchase (19/9/26).
$10,000/mo
Anthony Sabato monthly payments to Adam
Approx. $76,000 total across April 2024 – January 2025, in monthly tranches of ~$10,000. Continued in May 2025 ($10,000). Reference labels include "rent", "dividend payment", "refund", "June 2023 Payout", "July and August Pay", and "being a homose" (sic). Sabato is co-purchaser with Adam on multiple properties (81 Hayward Ave Torrensville; 19 Penley Ave Wingfield; 131 May Tce Ottoway).

Other cash deposits to Adam (account 9381)

  • Vincenzo Visconte β€” $1,000 (11/10/24); $1,000 (23/12/24)
  • Peter A Bellas β€” $7,600 (20/01/25)
  • Laurence Perone β€” $3,382 (1/05/24); $3,382 (11/06/24)

Outbound payments of note

  • Fabio Perrone β€” $12,500 (02/06/25) β€” purpose unexplained
  • Josef Michael β€” $6,000 (09/07/25) β€” purpose unexplained
  • Karen Paulina Fernandez Gonzalez (ex-partner, DV charges withdrawn) β€” approx. $10,000 total in payments ranging $110–$500 from Feb 2023 onwards
  • GM Tax & loans β€” $3,590 (09/04/25)

Income concealment scheme (per Gianna's evidence)

Adam's accountant (GM Tax) advised him to "move money around" β€” Adam began making large transfers from his personal ANZ account to trust accounts as a new practice in 2025. This pattern, combined with the unexplained inbound deposits and the delta between bank-disclosed and CS-disclosed income, supports an asset-shifting / income-concealment hypothesis.

❄️ Air Conditioning Business β€” Active While Claiming Inability to Work

Adam has stated in proceedings that he is unable to work due to injury. Bank transactions and a public Facebook post directly contradict this. His Refrigeration & Air Conditioning Licence is also expired β€” meaning any current trade work is unlicensed.

UNLICENSED TRADE
Refrigeration & A/C Licence has expired

🏠 6 Bruce Street, Broadview β€” Sub-let Arrangement

SUB-LET

Additional terms expressly state: "The two tenants (Adam and Kosta) have the authority to sub-let the property as share housing." Each room tenant signs a CBS Rooming House Agreement. A 4-bedroom share-house arrangement at $923/wk cost-base could yield $400–$700 per week per room β€” gross potential $80K – $145K/year. None of this income appears in Adam's CS or SOFP disclosures.

  • "Nothing to do with him"; doesn't believe contact would have any benefit
  • Phone calls described as "very triggering" by his psychologist
  • Primary attachment: mother + Anthony Kaviyani

Risk assessment (per consultant)

Risk from father: family violence allegations; drug-use allegations; dangerous-driving allegations; aggressive/threatening conduct; pending criminal charges (threats, messages, drug offences); firearms charges referenced; Adelaide United soccer-game incident.

Risk from mother (per father's allegations): high-stress environment; limiting Alessandro's relationship with father; information-withholding.

Risk to child: psychological distress from family conflict; ongoing exposure to disputed allegations.

People newly referenced in Family Report

  • Belinda Fuller β€” Panel Family Consultant (report author)
  • Mr Mark Byron β€” Adelaide Narrative Therapy Training (father's recent engagement)
  • Mr Williams / Ms Max Williams β€” psychologist re father's alcohol abuse

πŸ“ Child Impact Report (CIR)

Earlier (and separate from Family Report) court-commissioned report focused on Alessandro's welfare. Documented the foundational concerns that drove subsequent orders.

Detailed analysis of the CIR is in the existing Child Welfare section. Key items:

  • Adelaide United soccer-game incident (Adam yelling at screen)
  • Alessandro's expressed safety concerns
  • Recommendations re father's behavioural change program
  • Subsequent CARL reports (one filed Feb 2024 same day Adam lodged proceedings β€” flagged as suspicious timing)

βš–οΈ Independent Children's Lawyer β€” Recommendations

Annette Comley (Comley Legal) acts as Independent Children's Lawyer in this matter. ICL outline of case dated 12 March 2026 reviewed.

29 Jan 2026
Urgent letter from Father's counsel to ICL
Elena Leonardos (Adelaide Legal Solutions, for father) wrote to Annette Comley raising allegations from Gianna's GP notes β€” alleged undisclosed Bipolar diagnosis; opioid-dependence history; DASSA discharge against advice; court-stress diazepam over-use. Letter foreshadowed application for urgent delivery of the child + leave to file further affidavit.

Mother's responses

  • Dr Sheeper Ahmed letter (2 March 2026): no current bipolar symptoms; patient stable + compliant
  • Hair-follicle test (27 Mar 2026): positives explained as legitimate metabolites of prescribed Diazepam + Stilnox + post-surgical Codeine
  • Medical records contextualised across 20+ years of psychiatric care

All positives explained by prescribed medication
Codeine ← Comfarol Forte (paracetamol+codeine) prescribed Dr Sheeper Ahmed 18 March 2026 for pre-surgery pain.
Diazepam ← directly prescribed (Antenex 5mg twice a day for anxiety).
Nordiazepam, Oxazepam, Temazepam ← these are metabolites of Diazepam (and Temazepam can also derive from Stilnox metabolism). All explainable as legitimate by-products of the prescribed regimen.
Phentermine (would show as amphetamine-like) prescribed 24 March 2026 for pre-surgery weight loss β€” Gianna says she took only one dose ("did not agree with me; worried about it showing positive for amphetamine"). Test was negative for amphetamines, consistent with that account.

Prescription medication corroboration (CamScanner photo of pharmacy packaging, 14 April 2026)

  • Stilnox CR 12.5 mg (zolpidem) β€” sleeping β€” TerryWhite Chemmart Fulham β€” prescribed 10/04/2026

All prescriber: Dr Sheeper Ahmed, Croydon Family Practice (provider 2506678x).

Independent medical context

Dr Sheeper Ahmed letter (2 March 2026): Has known Gianna professionally since 3 January 2017. "I have not noted her to have any symptoms or manifestation of Bipolar disorder. This was a diagnosis made by another doctor much earlier, but I could not find any current symptoms or features to support it." Mental health stable; medications well-managed; considering wean-down.

Dr Richard Weeks letter (8 April 2019): Confirms historical opioid dependency post-2018 IVF miscarriage (peak: 50–60mg Endone + 100mg Oxycontin + 8–10 Panadeine Forte/day). Successfully addressed via DASSA voluntary admission 2–5 March 2023 (insight into risks; reducing driving with child; goal cease opioids on discharge). 3-year abstinence followed; only recent re-introduction is the 18/03/2026 pre-surgery Comfarol Forte (used sparingly).

GP consultation notes: 28/04/2025 (Stilnox dose review); 31/07/2025 (court stress β†’ diazepam 4 tablets/day, advised limit); 24/02/2026 (Valium weaning plan: 4β†’3β†’2 over 4 weeks; "no signs of emotional or mental instability").

πŸ“… Specific DV Incidents

During marriage
Pattern of emotional + coercive control
Per Gianna's "DV Info for lawyer" (5 Feb 2025): years of abuse, started young, escalating through emotional / psychological / coercive / harassment / intimidation / financial control. Per Villano affidavit 19/08/2025 (para 15): at least three instances of physical abuse alleged.
2021–2024
Westlakes incident β€” post-separation
Adam allegedly kicked Gianna out after becoming angry; Alessandro became scared, crying "because he thought his dad was going to hit me"; Adam reportedly infuriated that Alessandro was upset, blamed Gianna for "making him angry".
Christmas 2023
DV incident β€” Alessandro asked to come home
Alessandro asked to be returned to Gianna's care. Adam reportedly told him: "no, it will look bad on me and cause me problems."
2023 (date unspecified)
Adam arrested for DV
Per Gianna's evidence β€” Alessandro was instructed by Adam to lie / not disclose the arrest to Gianna "as it would cause problems for him."
2023
Shower event β€” DV in Alessandro's presence
SAPOL conducted a CARL report. Alessandro mentioned the incident in the Child Impact Report. Per Alessandro's psychologist homework (Nov 2025), the event affected his sense of safety and control.
15 July 2023
Karen Paulina Fernandez Gonzalez β€” Aggravated Assault charge
Adam's ex-partner made an aggravated-assault complaint against him. Charge subsequently withdrawn at her request. Adam paid Karen ~$10K total in $110–$500 tranches from Feb 2023 onwards.
"End of school" event
Police welfare check + manipulation of Alessandro
Police welfare check occurred. Adam later told Alessandro "your Mum called the Police on you" and falsely claimed police agreed Adam was right to discipline him. Reframing of the incident to alienate Alessandro from Gianna.
2024 onwards
AVO breaches
Despite AVO + ICL orders requiring Adam to remain β‰₯50 m from Gianna and Alessandro, the orders were allegedly ignored.
After proceedings began
Surveillance of Gianna's home
Reported to police. Day after proceedings began, Gianna's home was surveilled.
2024–2026
Cyberstalking via text β€” Alessandro
Adam sent extensive texts to Alessandro causing distress. Alessandro screenshot the messages, sent to Gianna asking her to help stop it. Eventually blocked Adam's number.
8 March 2026
Medical-records breach β€” defamation pattern
Adam shared Gianna's subpoenaed medical records (an unauthorised use of subpoenaed material). Spread "opioid addiction" rumours at Alessandro's soccer club. Shared with Robert's ex-wife Jacquie, who reported Adam to SAPOL.
10 April 2026
Package delivered to mother's home address β€” Alessandro's birthday
$200 Nike shoes delivered by an unknown person in a black cap, to Gianna's home address, on Alessandro's birthday. Not via standard courier. Direct safety concern.

⚠️ Adam's DV History

The Karen Paulina Fernandez Gonzalez matter is significant because it occurred AFTER the separation from Gianna and demonstrates a pattern of post-Gianna intimate-partner conduct β€” undermining the framing that Gianna's allegations are isolated/false.

Karen Paulina Fernandez Gonzalez β€” Aggravated Assault (15/07/2023)

  • Adam's ex-partner subsequent to Gianna
  • Aggravated Assault charge laid against Adam
  • Adam admitted in his own Notice of Risk (19/02/2025) that police attended and that there was a charge β€” characterised as "withdrawn at her request"
  • Adam paid Karen approximately $10,000 total from February 2023 onwards in payments ranging $110–$500 β€” pattern consistent with hush-money / compensation following an alleged DV incident

Pattern indicators

  • Adam ticked "NO" on substance-misuse risk in his Notice of Risk against Gianna β€” yet his own cannabis-cultivation charges were already laid by then, and the cannabis was found at the address where Alessandro had lived
  • 27 July 2025 birthday-call β€” Adam admitted to Alessandro that he had "had a few" before calling, then blamed Alessandro for not engaging
  • Persistent FaceTime attempts via brother Paul's phone after his number was blocked (10 Aug 2025) β€” boundary-violation pattern

πŸ“‹ Notice of Risk β€” Both Sides

Gianna's Notice of Risk (filed 18 January 2024)

Filed alongside Application for Family Violence and Application in a Proceeding. Foundational document opening the family-law matter. Specific allegations against Adam covered in Affidavit attached to filing.

  • Family violence β€” physical, emotional, coercive, financial
  • Alessandro's exposure to incidents (CARL report)
  • Safety concerns about ongoing contact

Adam's Notice of Risk (sealed 19 February 2025)

  • Alleges Gianna has depression with "many episodes and two suicide attempts" during the relationship
  • Alleges child "appears anxious" in Gianna's care
  • Ticked "NO" on substance-misuse risk β€” despite his own concurrent cannabis-cultivation charges and historical evidence of his alcohol use (per Ms Williams psychological report)
  • Admitted DV police attendance with ex Karen Paulina Fernandez Gonzalez (15/07/2023 Aggravated Assault β€” withdrawn)
  • Sworn allegations against Gianna in companion Sealed Affidavit of Non-Filing FDR (sworn 19/02/2025 before Sophie Jane Eldredge Gauvin):
    • "Mother has had depression since she was a child and has been on various medication since she was 15 years old"
    • "Mother takes prescription medication, such as Tramadol, Endone and Oxycontin" β€” sworn allegation
    • "Mother is emotionally abusive to the father and denigrates the father to the child"
CONTRADICTED
Adam's allegations rebutted by independent evidence
Dr Sheeper Ahmed letter (2 March 2026) directly addresses the prior bipolar diagnosis: "I have not noted her to have any symptoms or manifestation of Bipolar disorder." Multiple psychiatrists since 2009 have consistently found NO bipolar (only depression with anxiety). Hair-follicle drug test (27/03/2026) returned negatives for Tramadol, Endone, and Oxycontin (the drugs Adam swore she takes). Positives are explained as metabolites of currently-prescribed Diazepam + Stilnox + post-surgical Codeine.

πŸ” Litigation as Continued Abuse

Pattern of using the legal/administrative system itself as a continuation of the abuse β€” sometimes called "post-separation abuse" or "litigation abuse" in DV literature.

Documented patterns

  • Disclosure obstruction β€” May 2022 β†’ January 2024: 18 months of non-response and partial disclosure documented in Afortiori 25 June 2024 letter; characterised mother's discovery requests as "oppressive and unhelpful"
  • Job loss β€” Gianna lost her Bendigo Bank position due to court demands (medical appointments, stress leave, repeated absences)
  • Female-counsel request β€” Gianna stated she experiences DV-related anxiety with male barrister Ross; requested female counsel; counsel had failed to reference key medical documents in argument
  • 17-page DV history thrown out of court β€” per Gianna's evidence; rationale not yet captured
  • Address inconsistency β€” Adam's Affidavit 9 April 2026 lists residential address as 61 Riverside Drive Fulham; bail conditions require him to reside at 1/81 Hayward Ave Torrensville; his SOFP signature lists 3 Leith Price Court West Lakes; CBA loan documents list 71 Muller Rd Hampstead Gardens. Multiple address relocations in 2023, of which Gianna was unaware of two.
  • Subpoena misuse β€” Adam's counsel subpoenaed Gianna's medical records; the records were then shared inappropriately (not used solely for the subpoenaed purpose) β€” at Alessandro's soccer club, with Jacquie (Robert's ex-wife)
  • Surveillance / safety concerns at Family Report appointment β€” Belinda Fuller's intake letter explicitly asked re existing/pending FV orders; Gianna brought Anthony for safety on the day of the assessment

Cross-allegations: Adam's framing

Adam's counsel frames mother's withholding of contact (Jan–May 2025) and refusal to facilitate phone calls (post-29 Aug 2025) as parental alienation. Gianna's position is these were safety responses to specific incidents (Alessandro's "kill myself" statement; Adam's "had a few" call; Adam circumventing block via brother Paul's phone). The Family Report consultant's recommendations (page 28) align with the mother's safety framing rather than the father's alienation framing.

🏍️ "Mongols MC" Allegation Against Anthony Kaviyani

Adam alleged in proceedings that Gianna's partner Anthony Kaviyani is involved with the Mongols Outlaw Motorcycle Club. The allegation appears in (or is referenced in) one of Adam's earlier filings; Gianna's affidavit 19/08/2025 paragraph 13 expressly denies it.

Where the allegation appears

  • Implied / referenced in Adam's Sealed Affidavit Non-Filing FDR (19/02/2025) and / or his Notice of Risk (19/02/2025)
  • Denied by Gianna in para 13 of her Affidavit sworn 19 August 2025: "I have no idea... He has denied to me any such involvement"
  • Implied corroboration sought by Adam via group photo of male relatives (per GEV-3 contested context)

Relevance

The Mongols allegation is important because: (a) it would be highly material to parenting risk if true; (b) if false (i.e. unsupported by evidence), it is itself a form of post-separation defamation / process abuse; (c) it puts Anthony's identity into evidence as a contested factual matter, which then justifies countervailing OSINT review.

Recommendation: pursue documentary basis for the allegation (any photos, communications, association evidence Adam relies on). If none exists, the allegation should be expressly characterised as unsupported in any tendered Outline of Case.

πŸ”΄ Criminal Proceedings β€” Adam Morelli

Adam Isaac Morelli (DOB 27 November 1984) is the subject of three identified criminal matters. Two arose from search warrants executed in late January / early February 2024; one is a 2021 matter where Gianna was also named as a co-defendant.

PARENTING NEXUS
All firearms found at the address where Alessandro had lived
3 Leith Price Court West Lakes was Adam's residence β€” and at various times Alessandro's residence under shared-care orders. The arsenal includes a sawn-off rifle, a concealable pen gun, and a taser β€” none of which are lawfully held. Per the Family Report, Adam admits his DNA on the gun. Gianna's withholding of Alessandro from January 2025 was directly informed by these facts.

Lying about timing β€” carport door

Adam stated to SAPOL in his Facts of Charge that he had "only started locking the carport door 4 weeks ago" (December–January 2024). Gianna has video evidence of his Ferrari and Ford Falcon GT being parked in that carport in November 2023 β€” meaning the carport must have been securable before then. The statement appears designed to distance Adam from knowledge of the contents.

🚨 Bail Conditions

Adam is on bail subject to the following ongoing conditions, varied multiple times since 8 February 2024.

Current conditions (post most-recent variation)

  • Residence: 1/81 Hayward Avenue, Torrensville SA 5031 (since 25 March 2025; previously 61 Riverside Drive Fulham)
  • Reporting: weekly, every Friday, to Henley Beach Police Station
  • Firearms: NO possession of firearms or ammunition
  • Drug testing: gunshot-residue testing on demand
  • Travel: passport surrendered; cannot leave SA without leave
  • Travel exemptions granted: QLD 6–9 April 2025; Melbourne 6–20 June 2025
INCONSISTENCY
Adam's stated address conflicts with bail-required address
Adam's Affidavit dated 9 April 2026 lists his residential address as 61 Riverside Drive Fulham (a property he rented in 2023). Bail requires him to reside at 1/81 Hayward Avenue Torrensville since 25 March 2025. His SOFP signature (29 April 2025) lists "3 Leith Price Court West Lakes". The CBA loan applications (March 2026) list "71 Muller Rd Hampstead Gardens". These inconsistencies are themselves matters for the bail authority and the Court.

πŸ“… Trial Schedule & Sentence Exposure

Procedural history

  • 8 Feb 2024 β€” Information filed; Adam represented by Mr Y Yehia in early appearances
  • 3 July 2024, 18 July 2024, 20 August 2024 β€” Charge Determination Hearings (Magistrate Smart)
  • Subsequent committal to District Court
  • Adam now represented by Mark Sehler, Burns City Legal (Coburg, Melbourne) β€” 0412 293 793, mark@burncitylegal.com.au
  • Trial set down: 7–11 September 2026 (per Adam's correspondence with Burns City Legal)

Sentencing exposure (per Mark Sehler advice to Adam, captured in OCR'd correspondence)

  • Likely sentence range: 4–6 years imprisonment
  • Non-parole: 2–3.5 years
  • s 51 Sentencing Act 2017 (SA) β€” mandatory custodial sentence for serious firearm offences unless the Court is satisfied of "exceptional circumstances"
  • Conviction would also automatically trigger consequences for trade licensing (already expired)
FAMILY-LAW NEXUS
Sept 2026 trial coincides with family-law trial timing
A custodial sentence in September 2026 would directly affect Adam's ability to fulfil any parenting orders requiring his physical care of Alessandro. The risk needs to be expressly contemplated in any parenting orders sought, as does the risk that the sentence is imposed shortly after the family-law decision. The Family Report consultant's recommendation of "no contact subject to wishes" anticipates this risk.

πŸ“œ 2021 Joint Case β€” Adam & Gianna Co-Defendants

What we know

  • SAPOL reference: CO2100004226
  • Court: Magistrates Court of South Australia (Form 2 Information & Summons)
  • Date filed: 22 May 2021
  • Defendants (joint):
    • Adam Isaac Morelli (DOB 27/11/1984)
    • Gianna Elvira Morelli (DOB 25/02/1985) β€” yes, both named as defendants
  • Address at time: 1 Shelley Avenue, Fulham Gardens SA 5024 (joint residence)
  • Likely subject: "Interfere with Electricity Supply" (per email-sweep evidence β€” withdrawn at Port Adelaide Magistrates 14 June 2022; precursor to the 2024 cannabis-cultivation matter)

Significance

The 2021 joint matter at 1 Shelley Avenue is important context: (a) it confirms electricity-related offending preceded the 2024 cannabis cultivation charges; (b) Gianna's name being on the 2021 matter does NOT extend to the 2024 matter (which is at 2 William St Cavan, by then a property in Adam's trust); (c) the 2021 matter was withdrawn in June 2022, around the same time Adam and Gianna were attempting their parenting plan via the Family Relationships Centre.

πŸ‘₯ Family Network Criminal Context

Adam's first cousins β€” the Perrone family β€” are independently the subject of major Victorian criminal proceedings. Three of them are currently jailed for a 2023 group-shooting murder.

The cousins (per email evidence)

  • Christopher Perrone β€” currently jailed (2023 shooting murder)
  • Dion Perrone β€” currently jailed (2023 shooting murder)
  • Fabio Perrone β€” currently jailed (2023 shooting murder)
  • Laurence Perone (sometimes spelled Perrone) β€” only cousin not arrested

Sonza Market firebombings (precursor incidents)

Cousins' family business "Sonza Market" was firebombed on multiple occasions. Cars at cousins' homes were also firebombed. These incidents preceded the 2023 group-shooting murder and were widely understood within the family network as signalling escalating conflict.

$470,028
Adam β†’ Laurence Perone β€” 14 February 2024 β€” "Perone Fee"
A single transfer of $470,028.00 from Adam's account to Laurence Perone, labelled "Perone Fee", on 14 February 2024 β€” eleven days after Adam's own arrest on the firearms charges. Adam refused to clarify the purpose. Gianna's hypothesis: this funded bail or legal fees for one of the arrested cousins.

Fabio Perrone was granted $950,000 bail in approximately September 2026. Gianna believes Adam funded part of this from the proceeds of the Sandy Creek property purchase (19/9/26). The Sandy Creek facility ($900,000 from CBA, mortgaged to Paul Lampard + "Cyril" β€” both VIC residents who registered new ABNs the same year) has features consistent with a vehicle for bail-funding rather than a normal property investment.

Implications for parenting + DV

  • Alessandro travelled to Melbourne multiple times during 2023–2024 staying at cousins' residences β€” including the residence(s) at which the 2023 murder occurred
  • Cousin Fabio messaged Alessandro offering Drake concert tickets to lure him to Melbourne
  • Fabio later turned up at Alessandro's school and training (with Adam)
  • Adam's refusal to disclose his criminal-lawyer correspondence (Burn City Legal) is on the formal Missing Documents list β€” the omission limits the Court's view of the criminal exposure

⚠️ Adam's Notice of Risk vs His Own Charges

CONTRADICTION
Adam ticked NO on substance-misuse risk in his Notice of Risk
In his Sealed Notice of Risk filed 19 February 2025, Adam ticked "NO" against the substance-misuse risk indicator β€” yet by that date he was already charged with cultivation of a controlled plant (cannabis), possession of prescribed cultivation equipment, abstraction of electricity, and 8 firearms-related offences. The cannabis matter was not withdrawn until 8 August 2025. Either:
  • Adam considered cannabis cultivation not to be "substance misuse" (untenable), or
  • Adam knowingly answered the form falsely under oath
Both options have implications for credibility on parenting matters.

Other Notice-of-Risk inconsistencies worth flagging to Court

  • Adam admitted DV police attendance with Karen Paulina Fernandez Gonzalez (Aggravated Assault 15/07/2023) but did not flag this as relevant to risk indicators on his Notice
  • Pending criminal charges (per Family Report references): "threats" and "messages" charges in addition to firearms β€” these have not been highlighted in any of his risk disclosures
  • Adam's expired Refrigeration & Air Conditioning licence + ongoing trade work β€” relevant to his own credibility on "no rules apply to me" pattern

πŸ—‚οΈ Respondent's Trial Balance Sheet

Filed with the Respondent's Case Outline (doc #92) on 25 March 2026 for the Case Management Hearing of 30 March 2026 before Justice Kari. Numbers below are R's figures. This is the first formal disclosure of several previously-unseen liabilities.

NEW DISCLOSURE
Three previously-undisclosed liabilities totalling ~$1.16M now appear on R's balance sheet
  • CFA Finance (private lender): $900,000 β€” no prior reference in any disclosure to date; unknown lender, terms, security
  • Loan β€” Anthony Sabato: $70,000 β€” confirms a personal loan relationship with Sabato; consistent with (and partially explanatory of) the ~$270K in Sabato-Morelli money flows identified elsewhere in this report
  • ATO Debt: ~$190,000 β€” folded into the CFA Finance line on the schedule but acknowledged to be owed to the Australian Taxation Office

CROSS-REFERENCE
Implications for earlier Sabato analysis
The $70,000 "Loan β€” Sabato" line is the first formal written acknowledgement by Adam that Anthony Sabato is a creditor. Our forensic trace of the CBA/ANZ statements previously identified approximately $270,000 of gross flows between Morelli and Sabato accounts. The $70K debt figure accounts for only a fraction of that gross flow and does not explain the inflow side of the Sabato transactions. The 131 May Tce Ottoway 50% JT interest with Sabato β€” valued NIL by R, previously $415,000 β€” is disputed as to whether it forms part of the matrimonial asset pool.

🧠 Father's Psychiatric Assessment β€” Prof Ewer

Independent psychiatric evaluation of Adam Isaac Morelli conducted on 16 March 2026 by Professor Marty Ewer (Adelaide Wellbeing Practice). 29-page preliminary report prepared at the joint request of ALS (Ms Leonardos), Afortiori (Ms Larizza) and Comley Legal (Ms Comley, ICL).

HEADLINE β€” CHILD FOCUS
Prof Ewer: Adam is focused on his own needs, not Alessandro's
Prof Ewer's own summary: "Mr Morelli presented as being focused on his own needs rather than 'child' focused, engaging with Alessandro according to his own emotional, psychological and practical needs rather than Alessandro's."

He also presented as "largely unaware of Alessandro's needs as separate to his, acknowledging that he has often treated him more as a friend than his child, thus exposing him to various inappropriate adult-based activities, experiences and conversations."
BEHAVIOURAL INCIDENT Β· CIR ASSESSMENT
Explosive anger when told Alessandro would not meet him β€” documented by the CCE
When the Court Children's Expert informed Adam that Alessandro was unwilling to meet with him and suggested he engage a "Men's Behaviour" specialist, Adam "quickly became very emotionally heightened… forceful, angry manner" and demanded Alessandro be "forced" by the Court to stay with him β€” asserting a "family associate in Adelaide who prepares reports for the Family Court has advised him this is the only viable approach."

The report records: Adam "stood up and while pacing forward 1-2 steps, forcefully hit his hand into his fist while emphatically stating in an elevated voice 'that's my fucking son, my son, he's coming to a house of love'. It took some time for him to de-escalate for the interview to be terminated."

Adam's account to Prof Ewer: "that is 100% incorrect" β€” directly contradicting the contemporaneous CCE record.
CRIMINAL HISTORY & PENDING CHARGES
Firearms committal May 2026 Β· aggravated assault Β· choking Β· prior IOs
Prof Ewer's report records Adam's criminal matters as reviewed from police and file material:
  • Pending firearms offences β€” proceeding to a committal hearing in May 2026
  • Charges of aggravated assault and choking a person
  • Two Intervention Orders (2022–2024) β€” later revoked
  • Allegations of family violence in Adam's subsequent relationships (2022–2024)
  • 2021: tampering with a metre β€” fine
  • 2021: failing to cancel registration of a transferred vehicle within 7 days
  • 2010: driving with excessive blood alcohol
  • 2006 and 2007: driving unregistered (Γ—2 convictions)
  • Drug charges were withdrawn
DCP (Department for Child Protection) β€” 4 notifications since 2023 alleging Alessandro's exposure to arguing/family violence in Adam's household, Adam sending Alessandro inappropriate text messages, and concerns including coercive control, verbal abuse of Ms Villano, property damage, and exposure to drug and gun raids.
OPIOID SELF-DISCLOSURE β€” CONTRADICTS NOTICE OF RISK
Adam takes OxyContin and Panadeine Forte "as required" β€” but ticked NO on substance-misuse on his sworn Notice of Risk
Adam disclosed to Prof Ewer that he is currently prescribed:
  • Cipramil 40 mg daily
  • Nexium 40 mg daily
  • Mobic as required
  • OxyContin (opioid) β€” as required
  • Panadeine Forte (codeine) β€” as required
In his Sealed Notice of Risk filed 19 February 2025, Adam ticked NO against the substance-misuse risk indicator. At that time he was already charged with cultivation of cannabis, cultivation-equipment, abstraction of electricity, and 8 firearms-related offences β€” AND on his own account taking PRN opioids and PRN codeine. He also acknowledged historical cannabis (age 18, ~6 months) and cocaine ("once or twice"). This contradicts the sworn NO answer (see Criminal Β· NoR inconsistency section).
ALESSANDRO'S REPORTED EXPERIENCES (reviewed by Prof Ewer)
Child's own allegations β€” Prof Ewer documents these and records Adam's denials
Alessandro (12) described to the CCE and the Family Consultant:
  • Adam frequently "angry and dysregulated over small things"; threatened to throw the game controller at the TV when losing online games
  • Adam "yelled at and swore at him most days"
  • Adam was "reactive, angry and erratic when driving," making Alessandro feel "anxious and unsafe"
  • In 2023, Adam "angrily grabbed" his then-partner Karen in the bathroom while Alessandro was showering β€” Adam's account: he merely "put my arm around Karen and ushered her out"
  • Adam allegedly sent Alessandro photos of women asking him to rate them out of 10 β€” Adam: "I cannot remember doing that" and agreed "to do this would be inappropriate"
  • Adam allegedly took Alessandro to a warehouse with a "funny smell" β€” later identified as drugs by Adam himself
  • Alessandro alleged Adam encouraged him to steal small things β€” Adam denies
  • Alessandro accompanied Adam on numerous dates with women and approximately ten times to Court
  • Alessandro described experiences of being "demeaned," mocked, and called derogatory names
  • Alessandro recalled an incident where he believes "his father was about to hit his mother"
  • Alessandro is adamant he does not want contact with Adam; fears that if he re-engages he will "go to waste" (stealing, dropping out of school). He has threatened to kill himself if made to resume contact.
DOMESTIC VIOLENCE β€” PATTERN ACROSS RELATIONSHIPS
Multiple partners; SAPOL involvement in 2022–2024 relationship
  • Gianna alleged Adam grabbed her by the throat and pressed his chest against her; Adam: "completely false"
  • Gianna alleged Adam engaged in property damage and degrading, emotionally abusive behaviour
  • DCP July 2023: allegation that Adam grabbed his partner around the neck and dragged her through the home
  • DCP March 2025: Adam perpetrated family violence including verbal abuse of Ms Villano, property damage and coercive control
  • Adam's own admission to Prof Ewer: property damage β€” broke two plates, damaged a door, punched a door (last ~2019); he and Gianna both "yelled, screamed, swore" (attributed to "European heritage")
  • Adam described his 2023 relationship (with Karen) as "very toxic"; Alessandro "may have heard yelling/screaming"
  • SAPOL involvement re domestic abuse incidents between Adam and a subsequent partner 2022–2024
  • Anthony Kaviyani stated to the Family Consultant: Alessandro said Adam had "made comments about shooting Ms Villano"
DIAGNOSTIC FRAMING β€” WITH CONDITIONAL CAVEAT
Prof Ewer's diagnosis depends on whether Adam's denials are accepted
Prof Ewer noted on objective testing: SAPAS 1 (below PD threshold); PAI "mildly endorsed" a few critical items. On Adam's account alone, he "does not currently meet the diagnostic criteria for any significant psychiatric disorder."

But Prof Ewer's crucial conditional: "If Mr Morelli's account is accepted, he probably has mild personality problems and I note his criminal record. If a number of the assertions made about him are accepted, then the personality problems are probably more significant."

Given the weight of documented external material (CCE record of angry outburst, DCP notifications, SAPOL involvement, the child's own sworn disclosures, partner allegations, the sworn NoR inconsistency), the triggered branch of Prof Ewer's conditional is the more probable one: personality problems probably more significant.
PROGNOSIS & PARENTING β€” CONDITIONAL
If allegations accepted: Adam should NOT resume time until further treatment
Prof Ewer (Β§25.2): "If Mr Morelli's account is accepted, he probably could resume time with Alessandro. If a significant number of the assertions made about him are accepted, then he probably should have more treatment before resuming time with Alessandro. At that point, a decision could be made as to whether the time spending is initially supervised or not, depending on how he responds to further therapy."

On prognosis (Β§25.4): "If Mr Morelli's account is accepted, he has a favourable prognosis. If a number of the assertions made about him are accepted, his prognosis would be much less favourable."

Recommendations: 6–8 sessions CBT, continued Cipramil, a parenting program, and β€” on the allegations-accepted branch β€” additional psychotherapy to address the personality problems.

Adam's admissions on the record to Prof Ewer

  • Acknowledged treating Alessandro "as a friend rather than his child, thus transgressing boundaries"
  • Acknowledged some communication with Alessandro was inappropriate β€” "could send the wrong message to Alessandro about respecting women"
  • Property damage (broke plates, damaged/punched a door) β€” last in ~2019
  • Has "snapped" at Alessandro on occasions β€” "it's stupidity that gets me annoyed"
  • Admits teasing others, which Alessandro did not enjoy and for which he has apologised
  • Self-employed, manages 10 rental properties ~20 hours per week
  • Partner is Ms Micah Pimentel (12 months); her son resides in the Philippines
  • Asked to leave high school after arguing with a teacher; "asked to leave" again in Year 12
  • Engaged with Marc Williams (psychologist, 6 sessions per CIR recommendation); Melanie Xavier (reunification therapist β€” 1 "Men's Session" Dec 2025; told Prof Ewer he couldn't continue due to needing to finance his criminal matters); Mark Byrne at Adelaide Narrative Therapy (16 Dec 2025 and 3 Feb 2026 β€” so 3 sessions total despite claim to be "meant to be seeing him regularly")

Adam's denials on the record to Prof Ewer

  • Denied grabbing Gianna by the throat
  • Denied swearing at Alessandro
  • Denied angrily grabbing Karen (2023)
  • Denied asking Alessandro to rate women out of 10 ("I cannot remember doing that")
  • Denied encouraging Alessandro to steal
  • Denied monitoring Gianna or Alessandro β€” "absolutely not"
  • Denied becoming angry during the CIR interview β€” "100% incorrect"
  • Denied saying Alessandro should be "forced" to spend time with him
  • Re firearms: DNA on the weapon was "a low level" β€” attributes it to a rag he touched that someone else used to wrap a firearm; tenants' DNA also found

Objective psychometric results

  • SAPAS: 1 β€” below the 3+ threshold that identifies a DSM-IV Personality Disorder in 90% of people; "suggesting an unhelpful personality trait" (conditional on self-report honesty)
  • PAI Critical Items Test: mildly endorsed a few items
  • Note: both SAPAS and PAI are self-administered; the literature Prof Ewer cites (Appendix 1) notes self-interest and secondary gain may influence reporting in the medico-legal context

🧠 Mother's Psychiatric Assessment β€” Prof Ewer

Independent psychiatric evaluation of Gianna Elvira Villano conducted on 15 April 2026 by Professor Marty Ewer (Adelaide Wellbeing Practice). 45-page preliminary report prepared at the joint request of Comley Legal (Ms Annette Comley), Afortiori Barristers & Solicitors (Ms Marianna Larizza), and Adelaide Legal Solutions (Ms Elena Leonardos) β€” i.e. written instructions came from both parties' lawyers and the ICL.

HEADLINE FINDING β€” Β§25.5
Parenting capacity NOT compromised by psychiatric status
Prof Ewer's explicit conclusion (page 43): "Based upon Ms Villano's history, she is not suffering from any significant psychiatric disorder that would compromise her parenting capacity."
DIAGNOSIS
PTSD Β· opioid use disorder IN REMISSION Β· personality disorder RULED OUT
Prof Ewer (Β§25.3): "It is my clinical opinion, based upon a reasonable degree of medical probability, that Ms Villano is suffering from a post-traumatic stress disorder. The opioid use disorder is in remission."

"Ms Villano is probably not suffering from a personality disorder."

No current BPAD, no current MDD episode, no psychotic symptoms, no current depression, no suicidal ideation. Anxiety described but non-functionally-interfering. Gianna attributes her psychiatric problems to domestic violence.
OBJECTIVE TESTING
Psychometric results support PTSD and rule out personality disorder
  • SAPAS score: 2 β€” below the threshold of 3 that identifies a DSM-IV Personality Disorder in 90% of people (Moran et al. 2003). Indicates "some dysfunctional personality traits" but NOT a personality disorder.
  • PAI Critical Items Test: endorsed 3 of 4 PTSD items β€” strong objective corroboration of the PTSD diagnosis.
CONTRADICTION β€” R'S AFFIDAVITS
Multiple Morelli-filed claims about Gianna's psychiatric state are refuted by Prof Ewer
Adam's affidavit material (20 Feb 2026 Β§24.5; Notice of Risk 19 Feb 2025 Β§24.8; Affidavit 19 Feb 2025 Β§24.7) characterised Gianna's history as "long-standing and complex psychiatric history, including diagnoses of BD, MDD, anxiety, and substance dependence… multiple hospitalisations, suicide attempt, and ongoing use of prescription and illicit substances including Stilnox, Valium, oxycodone, and Panadeine forte." Prof Ewer's findings directly contradict key elements:
  • "Two suicide attempts" (Morelli) β†’ Prof Ewer documented ONE 2009 Stilnox overdose that Gianna described as "a cry for help"
  • "Ongoing use of illicit substances" (Morelli) β†’ Prof Ewer: cannabis used a few times ages 19–21, cocaine once; no illicit use in adulthood
  • "Dependence on Panadeine forte" (Morelli) β†’ Prof Ewer: opioid dependence (primarily OxyContin, prescribed) now in remission
  • "Complex psychiatric history, BD/MDD/anxiety/substance dependence" (Morelli) β†’ Prof Ewer: PTSD; opioid UD in remission; NO personality disorder; parenting capacity uncompromised
HAIR FOLLICLE & SURGICAL CONTEXT
Positive codeine result explained by prescribed endometriosis care
Hair follicle test of 26 March 2026 returned positive for a small amount of codeine. Context disclosed to Prof Ewer:
  • March 2026 β€” Dr Ahmed prescribed Panadeine Forte for endometriosis pain
  • 2 April 2026 β€” laparoscopic surgery for endometriosis; Panadeine Forte prescribed post-op, taken "sparingly" for a couple of days
The positive codeine finding is therefore consistent with prescribed, medically-justified use for an acute surgical condition, not illicit or recreational use.

PTSD clinical presentation (per Β§22 MSE and Β§9 self-report)

  • Regular intrusive recollections about the domestic violence
  • Hypervigilance β€” security cameras, triple-checks the house is locked at night, reluctant to have strangers behind her when alone
  • Exaggerated startle reaction
  • Nightmares of "being in a locked house and cannot get out"
  • Dissociative-quality flashbacks β€” "she relives being strangled"
  • Avoidance β€” does shopping by delivery; avoids going certain places alone
  • PAI: endorsed 3 of 4 PTSD critical items

Diagnostic history reviewed by Prof Ewer

  • 2006: Dr Allison β€” diagnosed BPAD after ONE consultation; Gianna reports never having a hypomanic episode; Seroquel ceased for side-effects
  • 2009: Dr Tom Paterson β€” agreed with BPAD
  • 2012: BPAD confirmed in file material
  • Dr Weeks (2019 letter to Dr Katsaneris): no manic symptoms, no anxiety symptoms, no psychotic symptoms; stated Gianna "remains stuck in a cycle of amotivation, prescription medication abuse and avoidance behaviour"
  • Current treating psychologist & Dr Ahmed (GP) β€” have diagnosed PTSD
  • Long-term GP since 2006: Dr John Tsavdaridis

Opioid history (Β§7, Β§8)

  • Opioid dependence period: approximately 5 years in total
  • In 2018, on some occasions took up to 400 mg OxyContin/day. Primarily prescribed medications (Endone, OxyContin, Targin, Panadeine Forte) for chronic back pain
  • Gianna: "I did have an opioid dependency. They were prescribed for me. I was dependent and that turned into misuse." "I have never obtained opioids illegally."
  • 2023 DASSA planned admission for opioid detox β€” discharged herself after 4 of the recommended 5 nights ("I felt fine")
  • Prof Ewer concludes: opioid use disorder in remission

Current treatment (Β§14)

  • Pristiq 100 mg daily (SSNRI β€” consistent with PTSD best-practice per ISTSS guidelines cited by Prof Ewer)
  • Stilnox 12.5 mg at night (being weaned; Dr Ahmed moved from 6.25 mg back to 12.5 mg with every-second-day omission plan)
  • Diazepam 15 mg daily (Prof Ewer flagged this as concerning given the addiction history)
  • Dr Ahmed (GP, as required); Ms Merk (treating psychologist, weekly)

Personal & occupational context

  • Lives with partner Anthony Kaviyani (engaged to be married) and Alessandro (12)
  • Alessandro diagnosed with PTSD and anxiety; sees a psychologist
  • Previously worked as a bank customer relationship officer (2023–2026)
  • Lost employment 16 March 2026 due to court-related absences
  • Miscarriage 2018 at 2 months
  • Laparoscopy 2 April 2026 (endometriosis)
  • Close relationship with both parents and younger brother; no adverse childhood experiences reported
TREATMENT RECOMMENDATIONS
Best-practice PTSD care
Prof Ewer recommends: trauma-focused CBT, EMDR (or EMDR 2.0), cognitive processing therapy (CPT), psychoeducation, trauma-sensitive mindfulness-based interventions, continued SSRI/SNRI (Pristiq is already appropriate), and ongoing psychological care. Flags the diazepam prescription for review given the addiction history. Notes 52% of people with current PTSD have co-occurring MDD, and cites literature that trauma-focused therapy should be prioritised over depression-focused treatment when both are present.
CHILD-FOCUSED PARENTING STATEMENTS
Gianna's expressed approach is aligned with best-practice parenting principles cited by Prof Ewer
In her own words to Prof Ewer:
"A good outcome from my parenting will be: Our son's wishes be respected. Our son to be safe and happy and have a relationship with his dad when he is ready to do so. Will have my support when the time comes. Stability and safety."

Her stated method: "seeing the psychologist regularly. Sole parenting ability to ensure stability. Never speak ill of his father and make him understand I am supportive should he ever want to speak to him/see him."

Her definition of a good parent: "someone who puts the needs and best interests of the child before their own or anything else. A good parent would go to any length to ensure the happiness and wellbeing of their child is priority."

This directly aligns with Prof Ewer's own cited framework ("be child-focused," "avoid denigrating the other parent," "postpone meeting their own needs when it is more appropriate to meet the child's needs").
ALESSANDRO'S WELLBEING IMPROVED UNDER GIANNA'S PRIMARY CARE
Measurable positive change since contact with Adam ceased in January 2025
Documented in the Family Report (Belinda Fuller, 30 Jan 2026) and Prof Ewer's review of file material:
  • "Marked improvement in Alessandro's grades and general coping/well-being since ceasing contact with Mr Morelli"
  • In 2023 Alessandro developed a severe head-shaking tic β€” his psychologist at Umbrella Psychology advised it was anxiety-based; recurred 2024; "largely resolved since Alessandro ceased contact with Mr Morelli, as purportedly confirmed by his school and psychologist"
  • Alessandro describes his mother's household as "calm, regulated and supportive"; Ms Villano as "a stable presence whose values/lifestyle are more mainstream and therefore, more enabling/positive for him"
  • Alessandro reported "feeling safer, more settled and better supported" since residing primarily with Ms Villano
  • Family Consultant's assessment: Alessandro's statements were "asserted with feeling and consistency and appeared to genuinely reflect his beliefs and purported experiences"
DCP β€” NO CONCERNS RE GIANNA'S PARENTING
Department for Child Protection has not confirmed any parenting-capacity concerns
Gianna to Prof Ewer: "the Department for Child Protection (DCP) have not confirmed any concerns about her parenting capacity." This is consistent with the Family Report notes (DCP's 4 notifications since 2023 concerned allegations against Mr Morelli's household and environment β€” not Ms Villano's care).
NO COERCIVE CONTACT INTERFERENCE
Gianna continued to facilitate contact with Adam despite her concerns
Family Report / Prof Ewer's review: "Ms Villano consistently reported that she wants Alessandro to maintain some form of contact/relationship with Mr Morelli as she believes their relationship is important. She reiterated that since separation she has sought to facilitate this despite her concerns/frustrations about alleged aspects of Mr Morelli's manner of engagement, lifestyle and care of Alessandro."

She has "insisted to Alessandro that he take his father's phone calls, despite his (Alessandro's) strong resistance" including Alessandro becoming angry at her and increased feelings of anxiety/distress. The Family Consultant summary: "Ms Villano conveyed no obvious ill-will or anger towards Mr Morelli." This directly refutes Adam's persistent allegation of parental alienation.
CREDIBILITY NOTE
Prof Ewer's standard internal/external consistency checks
Prof Ewer applies the same methodology to both parents (see Father's Psychiatric Assessment): he assumes truthfulness unless there are internal inconsistencies or external contradictions with ancillary material. In Ms Villano's case he records differing perspectives between the parties on DV occurrence, Adam's involvement in caring for Alessandro, the BPAD diagnosis history, and whether she obtained opioids illegally. Gianna denied obtaining opioids illegally; Prof Ewer does not challenge that denial, does not identify any material internal inconsistencies in her history, and concludes there is no current significant psychiatric disorder compromising her parenting.

πŸ“‹ Respondent's Case Outline β€” Trial Plan & Witnesses

Proposed trial plan β€” 5 days

TACTICAL SIGNAL β€” XXN OF GIANNA'S PARTNER
R allocates 1 hour on Day 2 to cross-examine Anthony Kaviyani
R's trial plan explicitly targets Ms Villano's fiancΓ© for cross-examination. This is significant because:
  • Anthony Kaviyani is the person Adam has repeatedly (and without foundation) alleged is "a member of a bikie gang" with "criminal activities" β€” an allegation Gianna has expressly denied and for which there is no evidentiary support
  • Mr Kaviyani told the Family Consultant that Alessandro reported Adam "made comments about shooting Ms Villano" β€” a critical piece of DV evidence R will seek to undermine under cross-examination
  • R budgets 4 hours to cross-examine Ms Villano herself (morning + afternoon of Day 1 plus 1 hour Day 2 AM) β€” a full day focused on attacking her credibility
  • R budgets only 30 minutes for the applicant to XXN Mr Morelli and then an additional 4 hours for the applicant's further XXN of him
The plan signals R will attempt to re-ventilate discredited claims against Ms Villano (alienation, psychiatric history, substance use) and to attack Mr Kaviyani's character β€” despite Prof Ewer's findings refuting the psychiatric allegations and the Family Report rejecting the alienation narrative.
OTHER R WITNESSES
Respondent's Accountant & Pharmacologist flagged
  • Respondent's Accountant (Day 3 PM, 1 hour) β€” R intends to defend the financial schedule; expect evidence focused on justifying the newly-disclosed CFA Finance $900K, Sabato $70K, and ATO ~$190K liabilities, and on the valuations attributed to the trust-held properties
  • Pharmacologist (Day 4, "if required," 1 hour) β€” clearly positioned to give evidence on Ms Villano's prescribed medication regime (Pristiq, Stilnox, diazepam, and any detected codeine) to attempt to re-open the substance-dependence narrative β€” notwithstanding Prof Ewer's finding that the opioid use disorder is in remission and Ms Villano's hair-follicle result being explained by legitimate post-surgical codeine use
  • Dr Martin Ewer (Day 3 AM, 1 hour) β€” the report's own author; expect cross-examination on the conditional caveats in the Father's report (the "if allegations accepted" branch) and on the Mother's PTSD diagnosis
  • CIR Kate Waterston and CCE Belinda Fuller (Day 4) β€” authors of the Child Impact Report and Family Report respectively; their evidence is adverse to Mr Morelli and favourable to Ms Villano

πŸ“¨ Seaview Rd Relocation & Birthday Contact Letter

Letter from Adelaide Legal Solutions (Elena Leonardos, acting for Mr Morelli) to Afortiori Barristers & Solicitors (now acting for Ms Villano), responding to Afortiori's notice of potential contravention of Court Orders of Judge Parker dated 13 March 2026.

DELIBERATE GEOGRAPHIC PROXIMITY TO CHILD
Morelli to relocate within 50 metres of child's known location β€” despite child's stated fear and no-contact wishes
ALS disclosed on Adam's behalf:
"Mr Morelli's partner lives on Seaview Road within 50 metres of Henley Square. Mr Morelli stays with his partner often and will be relocating to this address as is his right to do."

ALS also stated it is "not unusual for our client to walk his dog at Henley Beach" β€” areas the child attends. ALS then proposes the child modify his behaviour: suggesting Ms Villano "have a discussion with the child about avoidance of attending in the location where our client intends to reside."

Significance: Alessandro has repeatedly told the CCE, the Family Consultant and Prof Ewer that he fears his father, does not want any contact, and has threatened self-harm if forced to re-engage. Adam's stated intention to move within 50 m of the child's residential area β€” and to continue walking a dog in the same areas β€” is consistent with the concerns Ms Villano has raised since January 2025 about Mr Morelli "monitoring hers and Alessandro's movements or having third parties do so on his behalf."

UNSOLICITED BIRTHDAY DELIVERY TO CHILD'S HOME
Adam announces via his solicitor that items will be delivered to Alessandro on 10 April 2026
The letter states: "noting that today (10 April 2026) is the child's birthday, Mr Morelli intends to have some shoes and a discreet birthday card delivered to the child's home address."

This is being done the same day as the letter, via solicitor notification rather than agreement, despite:
  • Alessandro's consistent, sworn position that he wants NO contact (face-to-face, phone, or written) with his father
  • Alessandro has repeatedly refused phone contact, has hung up, and has described calls as "very triggering" (per his own psychologist)
  • Family Report recommendation #83 that Alessandro "spend time and not contact with Mr Morelli subject to his wishes"
  • The child's stated fear that re-engagement would cause him to "go to waste" (stealing, dropping out of school) and threats of self-harm
Delivery of physical items to the child's address β€” particularly after a partner-relocation announcement to within 50 m of him β€” can reasonably be characterised as a controlling pattern dressed up as gift-giving.
POSSIBLE UNDISCLOSED PROPERTY INTEREST
Seaview Rd address not in any prior asset disclosure
The Seaview Rd address is not listed in any Morelli asset schedule to date (including R's Balance Sheet filed 25 March 2026). It is described only as the partner's home. Points to check:
  • Does Adam have any legal/equitable interest in the Seaview Rd property (tenancy, mortgage contribution, cohabitation)? β€” subpoena target
  • Adam told Prof Ewer "he stays with his partner" and "she and her son reside in the Philippines" for the partner's son β€” i.e. partner lives alone at Seaview Rd; Adam's "often" stays could equate to de-facto residence
  • A relocation (vs. visiting) changes his principal place of residence β€” relevant to service of process, financial obligations, and potential tax/Centrelink issues

What the letter admits (quoted / paraphrased)

  • Adam's lawyers acknowledge receipt of a potential-contravention letter from Afortiori concerning the 13 March 2026 Orders
  • They are "currently reviewing" the matter and will respond "in due course" β€” no substantive response yet
  • Adam's lawyers confirm proximity to Henley Square and intended relocation
  • Adam's lawyers confirm plans for a physical delivery to the child's home on the child's birthday
  • Adam's lawyers deflect the child's reported attendance at a police station by requesting "a better timeline" (which station, what time) β€” i.e. questioning, not addressing

Contravention context

  • Orders of Judge Parker, 13 March 2026, form the baseline β€” Afortiori wrote raising potential breaches
  • ALS's reply does not deny the conduct; it reframes it ("as is his right to do," "not unusual")
  • The letter should be read alongside the ICL and Family Report material β€” Alessandro's consistent no-contact position has been before the Court throughout
